10 Years On, Police Fails To File Challan Against ‘Powerful’ ACR

An officer of Jammu and Kashmir government, who is allegedly accused of fraud and criminal conspiracy is enjoying the prime posting of Assistant Commissioner Revenue (ACR) Samba, despite on bail.
Meanwhile, in an apparent attempt to ‘shield’ the powerful Assistant Commissioner Revenue (ACR) Samba, the police have failed to file challan despite passage of long ten years.
According to the highly placed sources in the Police Department, the accused ACR, Jatinder Mishra has been continuously trying to ‘influence’ the police officers, investigating the matter.
“The officer, misusing his official position, has influenced successive Investigating Officers in the matter and has also pressurised them to keep the matter in abeyance,” said sources, adding that he (ACR) has plainly told the Investigating Officers ‘not to file challan in the court.’
Sources further stated that the ‘powerful’ ACR has been enjoying the magisterial powers, despite being on bail in fraud, criminal conspiracy and other charges.
“It appears that the General Administrative Department has also been influenced by the accused officer, otherwise a person already accused in more than three charges, including criminal conspiracy has been placed on the prime position,” said sources, adding that the ACR is ‘surely influencing and affecting the investigation’.
Accordingly an FIR No. 206 dated 04-09-2010 is registered against him in Police Station, Samba under sections 120-A, 182, 420 and 506 RPC. Copy of the said FIR is in possession of The Typewriter.
“The accused Jatinder Mishra along with other two people have hatched a criminal conspiracy against the complainant and influenced the EO Municipal Committee Samba to get a map (Site Plan) approved in favour of his father,” reads the FIR, adding that the complainant vide through the medium of legal notice dated 12-08-09 inquired about the condition for issuing the site plan, but EO remained reluctant to reply to the legal notice and hence violated the terms of the legal notice.
The copy of complaint further reads that the complainant through the medium of application dated 18-09-2007 had informed EO Municipal Committee Samba about the fraud, to which EO responded on dated 29-10-07 that the same has been kept pending for verification of title.
“Inspite of the title verification, the site map for 8.07 marlas has been sanctioned by the EO MC Samba in favour of the accused by keeping aside revenue records and has acted as per the whims and wishes of the accused persons,” reads the complaint, adding that the complainant had also requested all the accused persons to spare his property, but they allegedly threatened the complainant.
Pertinent to mention that in the last 10 years, no challan has been presented by the police in this case and powerful position of Jatinder Mishra could be the probable reason behind it.
Moreover, Assistant Commissioner Revenue (ACR) Jatinder Mishra has also been accused of issuing fake RBA certificates in the capacity of Tehsildar Banihal. A case under FIR No. 16/2015-VOJ, dated 23-03-2015 was registered against him. However, he managed to get it stayed from the court.
Senior Superintendent of Police (SSP), Samba-Rajesh Sharma said that he has recently joined the district and will get into the facts soon. “I will look into the matter and see why this matter has been pending for so long and who is investigating officer,” Sharma said.
Talking to The Typewriter, Commissioner Secretary J&K General Administrative Department, Manoj Kumar Dwivedi said that he was unaware of the matter. “Nobody brought these facts to my knowledge so far. Since you have talked about it, I will certainly look into the matter and get details about it,” said Dwivedi.
