In violation of human rights, a police officer of Jammu and Kashmir Police is likely to face National Human Rights Commission (NHRC) in an alleged case of illegal detention.
According to the documents (in possession of The Typewriter), Rohit Gupta of Rehari Colony has accused Police Inspector-Ravi Singh of ‘illegal detention’.
“With the extension of jurisdiction of the National Human Rights Commission in the Union Territory of Jammu and Kashmir, the applicant is approaching this Commission seeking redressal of violation of his human rights by the Ravi Singh who in connivance with his accomplices committed criminal acts against the applicant,” reads the document, adding, “On 25-5-2012 Ravi Singh, then incharge Police Post Sarwal raided the house of the applicant and arrested him without any complaint and also took applicant’s valid licensed revolver.”
The copy of the complaint (in possession of The Typewriter) reads that immediately after the arrest of applicant, Ravi Singh, called Ankush Khajuria that he will plant witnesses against the applicant and file a complaint.
“After arrest of the applicant, his wife rang Dy. SP, Headquarters Jammu and Addl. SP, Crime Jammu and requested them that the Police had arrested her husband without any fault. These officers assured her that they will look into the matter and would see that no injustice is done if the applicant has not done any crime,” reads the complaint, adding that Ravi Singh accused the complainant of having a dispute of plot with Ankush Khajuria.
It reads that the family of the applicant informed his Counsel K.B. Gupta, Advocate who reached Police Post Sarwal and enquired about the complainant. “Ravi Singh did not tell the Ld. Counsel about the offences under which the applicant was arrested and asked the ld. Counsel that he will contact him in the morning i.e., on 26-05-2012,” reads the complaint.
The complaint reads that the perusal of the report submitted by the I/C Police Post Sarwal on the basis of the application filed by the Counsel of the applicant reveals that Ankush Khajuria had filed a complaint against Rohit Gupta.
“Incharge Police Post Sarwal arrested the applicant under pre planned conspiracy hatched by Abdul Rouf Lone SDPO in connivance with Ankush Khajuria,” reads the complaint, adding that incharge Police Post Sarwal in his report dated 26-5-2012, which he had submitted to the CJM, stated that the offences u/s 323, 307/452 and Arms Act 3/25 stand established against Rohit Gupta, whereas incharge Police Post had reported to have recorded the statement of Ankush Khajuria and his witnesses on 27-5-2012 evening.
Complaint further reads that the applicant had already submitted a complaint against Ravi Singh to Deputy Inspector General of Police Jammu – Kathua Range and also handed over one copy of this complaint to Senior Superintendent of Police (SSP), Jammu.
In the complaint, it is also submitted that the NHRC must peruse the report of the then incharge Post Sarwal dated 26-5-12, which was submitted in the Court of CJM Jammu on the basis of bail application has shown Revolver No. NP-FG 17591 Revolver 32 MK field Gun Kanpur 2007.
“The same can be verified whether the applicant was in possession of unauthorized Revolver or a licensed one. Ravi Singh intentionally did not verify the same and also did not seize the valid license of Revolver belonging to the applicant which was seized from the applicant on the night of 25-5-2012 only to falsely implicate the applicant u/s 3/25 A. Act in a false and frivolous case,” reads the complaint, adding that Ravi Singh also booked the applicant us 307, 452, 323 RPC on fictitious grounds and physically tortured the applicant during arrest for which the applicant prays that the appropriate authority be directed to dismiss Ravi Singh from his service in view of his inhumane and cruel conduct towards the applicant in violation of the conditions attending his service.
Speaking to The Typewriter, Inspector Ravi Singh said that there was a complaint against Rohit. “There is a challan in the court and charges are against him, ” Said Ravi, adding that there were family issues between then SDPO and father of the complainant.
“He thinks that SDPO is doing it, but fact is that there is a complaint against Rohit”, said Inpector Ravi.
